Intellectual Property & DMCA Policy
1. Overview & Scope
This Intellectual Property & DMCA Policy ("Policy") governs the ownership, protection, and enforcement of intellectual property across all web platforms, game experiences, Discord applications, custom 3D assets, scripts, graphical liveries, and services operated under reloadedWARE (reloadedware.com) and associated projects (including the State of Alachua roleplay universe).
reloadedWARE respects the intellectual property rights of others and complies with the Digital Millennium Copyright Act of 1998 (17 U.S.C. § 512) ("DMCA") and applicable international copyright standards.
2. reloadedWARE Proprietary Rights
A. Ownership of Platform Assets
Unless explicitly designated as open-source or public domain, all content published, created, or distributed by reloadedWARE is our exclusive proprietary property, including but not limited to:
- Custom 3D Models & Meshes: Vehicle models, building interiors, uniform/clothing models, props, and environmental builds.
- Graphical & Texture Assets: Department liveries (e.g., Alachua State Troopers, ACSO, AFR), custom UI/UX elements, logos, badges, and brand artwork.
- Code & Software: Custom Luau/Lua game scripts, web applications, Discord bot commands, backend database schemas, APIs, and algorithms.
- Audio & Media: Custom sound design, voice lines, siren audio modifications, and video assets.
B. Limited License to Users
Users are granted a personal, limited, non-exclusive, non-transferable, revocable license to access and interact with our assets strictly within official reloadedWARE games, servers, and web portals.
C. Prohibited Use & Asset Theft
You may NOT:
- Extract, rip, decompile, dump, reverse engineer, or scrape any 3D models, textures, or code from our game files or web systems.
- Re-upload, redistribute, resell, or include our proprietary assets in any third-party game, marketplace, or community.
- Claim authorship or ownership of any reloadedWARE or State of Alachua custom asset.
3. User-Generated Content (UGC) & Community Contributions
If you create, submit, or upload content to reloadedWARE platforms (such as custom vehicle liveries, CAD/MDT character data, community art, or bot inputs):
- Ownership: You retain ownership of your original copyrightable creations.
- License to reloadedWARE: By submitting content, you grant reloadedWARE a worldwide, royalty-free, perpetual, sublicensable license to host, display, adapt, and use your submission within the Services and marketing materials.
- Representation: You represent and warrant that your submissions do not infringe on the copyright, trademark, privacy, or proprietary rights of any third party.
4. Notice and Takedown Procedure (DMCA)
If you believe that any material available on or through reloadedware.com, our Discord services, or our game environments infringes upon your copyright, you may submit a formal DMCA Takedown Notice to our Designated Copyright Agent.
What to Include in a DMCA Notice:
To be legally valid under 17 U.S.C. § 512(c)(3), your written notification must include:
- Identification of the copyrighted work you claim has been infringed (or a representative list if multiple works are involved).
- Identification of the allegedly infringing material, including specific URLs, Discord message links, asset IDs, or game locations sufficient to allow us to locate the content.
- Your contact information, including your full legal name, mailing address, telephone number, and email address.

A statement of good faith belief:
"I have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law." -
A statement of accuracy and authorization under penalty of perjury:
"The information in this notification is accurate, and under penalty of perjury, I am the owner, or authorized to act on behalf of the owner, of an exclusive right that is allegedly infringed." - A physical or electronic signature of the copyright owner or person authorized to act on their behalf.
5. Counter-Notification Procedure
If you believe your content was removed or disabled by mistake or misidentification (e.g., you own the rights, have a valid license, or fair use applies), you may submit a formal DMCA Counter-Notification under 17 U.S.C. § 512(g)(3).
What to Include in a Counter-Notification:
- Identification of the material that was removed or disabled and the location where it previously appeared.
- Your contact information: Full legal name, address, telephone number, and email address.

A statement under penalty of perjury:
"I state, under penalty of perjury, that I have a good faith belief that the material was removed or disabled as a result of mistake or misidentification." -
Consent to jurisdiction:
"I consent to the jurisdiction of the Federal District Court for the judicial district in which my address is located (or if outside the United States, the appropriate judicial district where the service provider may be found), and I will accept service of process from the person who provided the original DMCA notification or an agent of such person." - Your physical or electronic signature.
Upon receipt of a valid Counter-Notice, reloadedWARE will forward a copy to the original complainant. If the complainant does not file a court action seeking a restraining order within 10 to 14 business days, reloadedWARE may restore the removed material.
6. Repeat Infringer Policy
In accordance with Section 512(i)(1)(A) of the DMCA, reloadedWARE maintains a strict policy to terminate or permanently ban users, Discord accounts, and platform profiles identified as repeat copyright infringers.
